Sean Johnson details his journey from childhood poverty and gang involvement in Asbury Park to receiving a 60-year sentence for a shooting at age 19. After 19 years of failed appeals and maintaining a clean record in New Jersey State Prison, he was granted clemency by Governor Phil Murphy, who commuted the final 41 years of his sentence. The narrative highlights the systemic biases in bail hearings, the 'trial tax' where plea offers are ignored for harsher sentences, and the critical importance of rehabilitation and legal advocacy in securing release.
“My first plea was 50 years... My bail was $1 short of $10 million... I'm sitting across from the governor, Phil Murphy. And he looked at me and he was just like, 'Sean, good morning to you.' And I'm just like, 'Good morning.' He like, 'How you feeling?' Like I'm I'm blessed. I woke up today. And he was like, 'Well, I'm about to make your day even better. I'm commuting your last 41 years off your sentence.'”
“They offered me right before trial 18 years, but they gave me 60. So that's that was the extreme trial tax that they basically tripled my time of what they offer me and I had 19 years in at this time.”
“They can do anything they want to to you as long as they give you a process to correct it... That's that's illegal. You can't think of what you you need to go through. Well, then you need to file a such and such... And what they you don't realize is no. We're going to now the whole system's designed to slow walk you.”
“I maintained that my faith like I'm going to get home. I don't know when it's going to happen. I don't know how it's going to happen. But I maintained that the whole time... It wasn't the appeal process. I didn't got denied multiple time. I was at the end of it and then it was the clemency walked me right out the door.”
“Out of every 3500 [2255] ineffective assistance of council, one person gets relief... That relief people think, 'Oh, he gets he goes free.' No, no, it got it's gotten accepted and there's some kind of a beneficial outcome... He might have just gone from 32 years down to 25 years.”
